NAMB APPEALS TO SUPREME COURT IN MCRANEY CASE, CLAIMS FIRST AMENDMENT PROTECTIONS

WASHINGTON — The North American Mission board has filed a petition with the Supreme Court of the United States in its ongoing case involving a lawsuit against the board filed by a former Southern Baptist state executive director.

The lawsuit, which was originally filed in 2017 by Will McRaney, former executive director of the Baptist Convention of Maryland/Delaware (BCMD), alleges NAMB had intentionally defamed him and wrongfully influenced his 2015 termination by the BCMD after a dispute over collaborative missions efforts in the region. NAMB legal counsel George McCallum called the allegations “unfounded” in a statement to Baptist Press in November of last year, adding that NAMB has “consistently denied” McRaney’s claims.

The lawsuit was dismissed by a lower court in April 2019 because of the judge’s concerns over the ecclesiastical abstention doctrine, which prevents the government from interfering in church or religious matters. But the 5th U.S. Circuit Court of Appeals overturned that decision in July 2020. [Read more…]

BARRETT CONFIRMED; SBC LEADERS FOCUS ON PRAYER

WASHINGTON — The U.S. Senate confirmed Amy Coney Barrett to the Supreme Court in a nearly party-line vote Monday evening (Oct. 26), and Southern Baptist leaders focused on prayer for the new justice.

The Senate voted 52-48 for confirmation of the federal appeals court judge. Only Sen. Susan Collins, R-Maine, broke from her party, joining with Democrats to oppose the confirmation.

Barrett was given the constitutional oath by Justice Clarence Thomas Monday night at an outdoor ceremony at the White House. Chief Justice John Roberts will administer the judicial oath to Barrett Tuesday (Oct. 27), the Supreme Court press information office announced Monday evening. [Read more…]

SUPREME COURT RULING DISAPPOINTS PRO-LIFERS

WASHINGTON — Pro-life leaders expressed deep disappointment with the U.S. Supreme Court’s refusal 29 to uphold a Louisiana law designed to protect the lives and health of women by requiring hospital admitting privileges for doctors who perform abortions.

In a 5-4 decision, the high court ruled the law — which mandated a physician must have admitting privileges at a hospital within 30 miles of a facility where he or she performs an abortion — violated the U.S. Constitution by imposing an “undue burden” on a woman’s right to the procedure. The justices found the Louisiana measure was nearly identical to a Texas admitting privileges law they struck down in 2016. [Read more…]

SUPREME COURT RULES IN FAVOR OF GAY, TRANSGENDER RIGHTS

WASHINGTON — The U.S. Supreme Court issued a watershed decision on gay and transgender rights today (June 15) by finding longstanding, non-discrimination protections in federal workplace law cover “sexual orientation” and “gender identity.”

The justices ruled in a 6-3 opinion the category “sex” in Title VII of the 1964 Civil Rights Act applies to homosexual and transgender employees. Chief Justice John Roberts and Associate Justice Neil Gorsuch — typically among the high court’s more conservative members — joined the four-member liberal wing in the majority. Associate Justices Clarence Thomas, Samuel Alito and Brett Kavanaugh dissented.

Russell Moore, president of the Southern Baptist Ethics & Religious Liberty Commission (ERLC), and others disturbed by the decision expressed concerns about its impact on religious freedom and the meaning of words in laws. [Read more…]
